Acceptance

These Terms of Service (the “Terms”) govern your access to and use of Elysium Labs’ products and services, including The Butler, The Bar, the Elysium dashboard, and this marketing site (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.

Description of service

Elysium is an AI assistant for the home. The Service includes software, devices (when offered), and cloud features that let you talk to The Butler, control compatible smart-home devices, and configure how the agent behaves.

Elysium is in active development. Features may change, improve, or be removed without notice during this period. We'll do our best to communicate material changes in advance.

Account and eligibility

You must be at least 18 years old (or the age of legal majority where you live) to create an account. You are responsible for keeping your account credentials secure and for activity that happens under your account. Use a strong password and enable MFA from the settings page.

One person, one account. You may not share credentials with others or transfer your account.

Acceptable use

You agree not to:

  • Use the Service to break the law or to harm other people, their devices, or their data.
  • Reverse engineer, probe, or test the vulnerability of the Service except as expressly permitted in writing.
  • Use the Service to send abusive content, spam, or automated traffic that disrupts the experience for other users.
  • Resell, sublicense, or run a commercial service on top of Elysium without a written agreement.

We may suspend or terminate access for accounts that violate these rules.

Intellectual property

Elysium and its licensors own the Service, including the software, brand, and content we produce. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use during the term of these Terms.

Content you create in the Service (conversations, memories, device configuration) belongs to you. By using the Service you grant us the rights we need to host, process, and display that content back to you and to operate the Service.

Third-party services

The Service relies on third parties for infrastructure (AWS), language models (e.g. Anthropic), and email delivery. Your use of those services through Elysium is also subject to their own terms. We do our best to choose providers whose data-handling practices we're comfortable with, but we are not responsible for their conduct or outages.

Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Elysium is not a safety system, and you should not rely on it for life-critical functions (medical monitoring, fire suppression, intrusion alarms, etc.).

Limitation of liability

To the maximum extent permitted by law, Elysium will not be liable for indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from your use of the Service. Our total liability for any claim related to the Service is limited to the greater of US$50 or the amount you paid us in the 12 months before the claim.

Termination

You may close your account at any time from the settings page. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. On termination, your right to use the Service ends and we will, where applicable, delete or return your data consistent with our Privacy Policy.

Governing law

These Terms are governed by the laws of the jurisdiction where Elysium Labs is established. The specific forum will be updated here once the operating entity is finalized. Until then, disputes will be resolved through good-faith discussion before any formal action.

Changes

We may update these Terms from time to time. Material changes will be announced in-product or by email. The “Last updated” date at the top of this page reflects the most recent change. Continued use of the Service after a change means you accept the new Terms.
